Why Responsible AI does not make a response enforceable

Responsible AI frameworks can improve fairness, transparency, and explainability. They do not, by themselves, make a response enforceable when challenged.

This article critiques a widespread myth. In the current ecosystem, much of the discourse around Responsible AI, algorithmic ethics, or biases aims to “make AI better.” These approaches are useful for reducing certain technical or social harms. They are not sufficient to answer a fundamental question: **when does an answer produced by an AI become legally, economically, and socially enforceable?**

What does Responsible AI actually promise?

In most frameworks, one finds objectives such as:

  • reducing biases;
  • improving transparency;
  • increasing explainability;
  • protecting privacy;
  • ensuring ethical use.

These are **desirable conditions**. They are **not sufficient conditions for enforceability**.

Why these frameworks fail in the face of enforceability

An enforceable answer requires a **reconstructible justification chain**, an **explicit source hierarchy**, **contradiction management**, **clear bounding**, and a **legitimate non-answer capability**. Yet:

  • most Responsible AI frameworks do not guarantee **reconstructible traceability**;
  • they do not define a **structuring source hierarchy**;
  • they do not constrain the AI to refuse to answer when minimum justification conditions are not met;
  • they do not systematically handle **indeterminacy** or contradictions between sources;
  • they rarely address the question of **human responsibility** attached to an automatic answer.

In these frameworks, an answer can be ‘fairer’ or ‘less biased’ without being **defensible** when contested.

Enforceability: a notion that goes beyond technical ethics

Enforceability is not a purely ethical or academic concept: it is a **legal and economic** constraint. It means that a produced answer can be defended without fiction before internal or external stakeholders (clients, regulators, courts, partners, insurers). For an answer to be enforceable, it is not sufficient that it be:

  • plausible;
  • explainable in the technical sense;
  • equitable in the bias sense;
  • superficially documented.

It must be:

  • bounded to a declared zone;
  • justified by a **transparent chain of sources and rules**;
  • handled in cases of **contradiction or absence of information** (legitimate non-answer);
  • assumable by a **clearly identified responsible human entity**.

The essential operational distinction

  • Responsible AI = a framework aimed at making AI more “acceptable” or “fair.” It is a **standard of conduct**.
  • Enforceability = the ability to defend an answer when stakes go beyond opinion. It is a **condition of responsibility and law**.

These are two complementary, **but distinct** registers.

Responsibility vs ethical intention

A system can comply with Responsible AI principles and yet produce an answer that:

  • is not traceable;
  • cannot be legally defended;
  • rests on no declared source hierarchy;
  • is contestable with no possibility of reconstruction.

Ethical compliance is not sufficient to **assume responsibility for an answer**.

What interpretive governance proposes

Interpretive governance aims precisely at what Responsible AI does not guarantee:

  • **structuring conditions** for an answer to be defensible;
  • **reconstructible traceability** from origin to output;
  • **interpretation constraints** rather than general recommendations;
  • a **legitimate non-answer capability** when conditions are not met;
  • a **source hierarchy** that guides explicit arbitration or refusal to decide.

This framework does not replace ethical principles: it **frames them to make them assumable** in real and engaging contexts.

Responsible AI is useful for guiding intention. Interpretive governance is necessary for governing **the conditions under which an enforceable answer is produced** — those which, in economic and legal reality, can be assumed when they are used, published, or invoked against an organization.
